01 · Value proposition

What I bring to an arbitral tribunal

01

Adjudicative experience

Since 2018, I have decided, as the final administrative instance, disputes between companies and public bodies: ministries, regulators, ESSALUD, SUNAT, regional and municipal governments.

02

Economic method

Costs, benefits and economic effects of measures and contracts. I read and test economic expert evidence.

03

Public-service standard

A role subject to sworn asset and interest disclosures and to the publication of every decision. I disclose broadly and accept only what I can decide with full independence.

02 · Representative decisions

Public decisions, read for their reasoning

Public SEL resolutions in which I took part as a Chamber member. They show method and the handling of disputes involving the State; they express no preference for any party.

Res. 0708-2024/SELMinistry of Education

Licensing of higher-education institutes

A differentiated ruling: several claims dismissed, other requirements upheld as lawful, a restriction on the general director position held unlawful, with general effects for all institutes concerned, and a requirement on work-training agreements held unreasonable, with effects only for the complainants, because the Ministry did not show the problem it sought to address or analyze its proportionality.

Why it mattersThe reasonableness test: the authority must prove the problem and the proportionality of the measure (Legislative Decree 1256, art. 18).

Res. 0011-2025/SELESSALUD

Social-security subsidies

Requiring the medical-certificate validation file within 30 working days was held unlawful: an additional condition, not provided for in the Law 26790 economic-benefits regulations, for reimbursing employers for subsidies paid.

Why it mattersHierarchy of norms in labor and social-security matters.

Res. 0146-2025/SELMinistry of the Interior and National Migration Authority

Passport appointments

Reversed the first-instance decision and held unlawful the requirement to book an appointment only online to apply for an electronic passport, with general effects. Clarified that online booking may remain if an in-person option is also offered.

Why it mattersThe right of petition and digital channels: online access broadens inclusion but cannot be the only route.

Res. 0044-2025/SELDistrict Municipality of San Juan de Miraflores

Municipal licenses

Disregarding an automatically approved license was held unlawful, while expressly preserving the municipality's inspection powers.

Why it mattersLegal certainty and public powers kept in balance.

How I work on a tribunal

Areas
  • Commercial arbitration with a regulatory or State dimension
  • Concessions, energy, infrastructure and regulated services
  • Construction, licenses and permits
  • International trade and investment
  1. 01

Contract and law first; then their effects.

Economic analysis organizes the evidence; it does not replace the applicable law.

  2. 02

The State as it really works.

I know how public bodies decide, within which legal limits and on what timelines.

  3. 03

    Expert evidence made clear.

Assumptions, rates and scenarios tested, so the award rests on evidence the tribunal understands.

  4. 04

    Real availability.

A limited caseload, handled personally and on time.

CARC-PUCP

2026 Roster of Arbitrators.

CARC-PUCP

Specialized Public Procurement Roster (Law 32069), as a specialized member.

While I serve as an INDECOPI Chamber member I do not accept appointments in public procurement arbitrations (Supreme Decree 009-2025-EF, art. 327).

Scope

As a non-lawyer, I may be appointed in international arbitration, ex aequo et bono, or domestic arbitration at law when the parties so agree (Legislative Decree 1071, art. 22).

I usually serve as co-arbitrator.

Ethics and independence

I bring the public-service standard to arbitration: broad disclosure from the first contact, recusal at the Chamber whenever an appointment requires it, and acceptance only of cases I can decide with full independence, from start to finish.

Five questions for reading a damages report (without being an expert)

When two expert reports reach very different figures, the gap usually comes down to a few assumptions. A tribunal that isolates and tests them decides, and reasons, better.
